犯法的人主动去向司法机关交待自己的罪行。对于自首的犯罪分子，可以从轻或减轻处罚，其中犯罪较轻的，可以免除处罚。被采取强制措施的犯罪嫌疑人、被告人和正在服刑的罪犯，如实供述司法机关还未掌握的本人其他罪行的，以自首论。

1. 自行投案，承认罪责。

   《后汉书·郅恽传》：“ 惲 即起，将客遮仇人，取其头以示 子张 。 子张 见而气絶。 惲 因而诣县，以状自首。” 南朝 梁武帝 《南郊大赦诏》：“各令自首，不问往罪。”《新五代史·梁臣传·寇彦卿》：“ 彦卿 见 太祖 自首， 太祖 惜之，詔 彦卿 以钱偿现家以赎罪。”《古今小说·汪信之一死救全家》：“ 革 子 世雄 知情与否，亦难悬断，然观 无为州 首词与同恶相济者不侔，似宜准自首例，姑从末减。”

2. 向敌人投降告密。

   鲁迅 《书信集·致曹聚仁》：“自首之辈，当分别论之，别国的硬汉比 中国 多，也因为别国的淫刑不及 中国 的缘故。” 胡丹沸 《把眼光放远一点》独幕剧：“ 老福 ，好好地想想吧！向敌人自首了，还算个 中国 人吗？”
