用法律治理国家。有形式法治和实质法治之说。形式法治指依法治国、依法办事的治国方式、制度及其运行机制；实质法 治指良法统治，法律至上，法律主治，制约权力、保障权利的价值、原则和精神。

1. 谓根据法律治理国家。与“人治”相对。

   《晏子春秋·谏上九》：“昔者先君 桓公 之地狭于今，修法治，广政教，以霸诸侯。”《淮南子·氾论训》：“知法治所由生，则应时而变；不知法治之源，虽循古终乱。” 邹韬奋 《抗战以来》六二：“在此种惨酷压迫之情况下，法治无存，是非不论。”亦指依法处治。《史记·蒙恬列传》：“ 高 有大罪， 秦王 令 蒙毅 法治之。”
