双方争执不决时，由第三者居中调解，作出裁决。法律上特指发生纠纷的当事人在自愿基础上达成协议，将纠纷提交非司法机关的第三者审理，由其作出对双方均有约束力的裁决，以解决纠纷的一种非诉讼方式。分国内仲裁和涉外仲裁。适用于平等主体的公民、法人和其他组织之间发生的合同纠纷和其他财产权益纠纷。婚姻、收养、监护、扶养、继承纠纷和依法应当由行政机关处理的行政争议不得仲裁。
